Terms of sale

You are buying from Anahita Eastwood, sole trader, trading as Anahita Eastwood. She is a working painter and ceramic sculptor based in Surrey, England.

She is not registered for VAT, so prices do not include VAT and no VAT invoice is issued.

When you complete checkout on the website, you make an offer to buy at the price shown. The contract of sale is formed when we send you an order confirmation email accepting that offer. Until then, no contract exists and no money leaves your account.

If a work has already been sold in the studio between your order and our confirmation (which can happen with an original), we will refund you in full within a few working days and let you know what else is available.

For a commission, the contract is formed when you sign the commission agreement and pay the agreed deposit.

Prices are shown in pounds sterling (GBP), inclusive of any tax due. Anahita is not registered for VAT, so there is no VAT to add. Insured UK delivery is included in the price of paintings and works on paper; sculpture is collected from the studio or delivered by arrangement.

We accept payment by card through Stripe Checkout. Stripe processes your payment on our behalf; we do not see or store your full card details.

If a price is displayed in error and the correct price is materially different, we will contact you before dispatch and give you the choice of paying the correct price or cancelling the order for a full refund.

For originals at one thousand five hundred pounds and above, we offer a payment plan of three monthly instalments by arrangement. The first instalment is paid at order; the second and third are taken on the same date in each of the two months that follow. The work is held in the studio while the plan runs and is delivered after the final payment clears. Please write to Michael before checkout to set the plan up; a written note confirms the amounts and the dates.

You may reserve a work for seven days with a ten percent deposit. The deposit is deducted from the price if you go on to buy, and it is refundable if the reservation is cancelled within the fourteen-day period. A reservation puts a hold on the work for you for the seven days; other offers are declined during that window.

Originals can be collected from the studio in Surrey by appointment (free of charge), or delivered within the United Kingdom by an insured art courier. Sculptures are collection only, because glazed and terracotta ceramic pieces do not travel safely by courier. For an original going outside the United Kingdom, please write for a quote before ordering.

Prints are printed and shipped by a specialist fine-art lab in the United Kingdom, and can be sent worldwide.

Risk in the goods passes to you when you (or someone you nominate, other than the courier) take possession of them: on collection, when they are handed to you at the studio; on delivery, when the courier hands them over at the delivery address.

If you buy from the website as a consumer, you have the right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You have 14 days from the day after you (or someone you nominate, other than the courier) receive the goods to tell us that you want to cancel.

To cancel, please email anahitaeastwood@yahoo.co.uk with your order number and a clear statement that you wish to cancel, or complete and return the model cancellation form at the end of this page. Your notice takes effect on the day you send it.

After telling us, please send the goods back to us (or hand them back at the studio) without undue delay, and in any event within 14 days. You pay the direct cost of returning the goods; for a large original we can quote for a courier collection. Please pack the work at least as well as it arrived, keep the original packaging where possible, and take reasonable care of the goods while they are with you.

We will refund the price of the goods, and the standard delivery cost, within 14 days of receiving the goods back (or, if earlier, within 14 days of you giving us proof of return). Refunds go to the card used at checkout. If the value of the goods is reduced by handling beyond what is necessary to establish their nature, characteristics and functioning, we may deduct that reduction from your refund.

The right to cancel does not apply to goods that are made or personalised to your specifications. Bespoke commissions (a work made to your brief) are therefore not returnable once we have started work, unless the finished piece does not match what we agreed in writing. Commission terms are set out in the separate commission agreement you sign at the start of the project.

Your rights under the Consumer Rights Act 2015 apply in full, and nothing in these terms takes them away.

If a work arrives faulty, damaged or misdescribed, please tell us within 30 days of delivery: this is your short-term right to reject, and we will refund you in full. After 30 days, you can ask for a repair or a replacement (where the work can be replaced); if repair or replacement is not possible or not successful, you can ask for a price reduction or a final refund.

Please keep the packaging as it arrived, take clear photographs (the unopened parcel, the opened parcel, and the work), and email them to anahitaeastwood@yahoo.co.uk within 48 hours of delivery so we can raise a claim with the courier promptly.

Every painting and every ceramic is unique. Screens vary, and no photograph shows a work exactly as it appears in the studio; colours may be a little warmer, cooler or more saturated on your device than they are on the canvas or glaze. Dimensions are given to the nearest centimetre (height first, then width, then depth for sculpture). We do not consider ordinary colour or dimension variation of this kind a fault.

Certificates of authenticity are supplied with every original and every signed limited-edition print, and travel with the work when it is sold on.

Copyright in every artwork, photograph and description on this site remains with Anahita Eastwood. Buying an original or a print gives you the right to enjoy and display the work; it does not transfer any copyright.

Please do not photograph a work for commercial reproduction, licensing or resale without written permission. Honest personal photographs at home, and honest reviews with pictures, are welcome.

These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from a sale under these terms.
